Nomad Sauna is a custom barrel sauna manufacturer based in Hudson, Wisconsin. Our Website serves as an informational resource about our products and as a platform through which customers may book individual sauna seats or private sauna rentals when available.

IMPORTANT: Custom sauna purchases do not occur through our Website. All sauna purchase transactions are conducted off-platform, after a direct sales consultation. The only transactions processed through our Website are sauna seat bookings and private rental reservations, which range in price and availability.

2. Eligibility and Geographic Scope

Our Website and services are intended for use by persons who are at least 18 years of age. By using our Website, you represent and warrant that you are 18 years of age or older. If you are under 18, please do not use our Website.

Our Website and services are intended for use by residents of the United States and Canada. We do not knowingly offer our services to residents of the European Economic Area or other jurisdictions outside of North America.

3. User Accounts

A. Account Creation

We may offer the ability to create a customer account on our Website. If you create an account, you agree to: (i) provide accurate, complete, and current information when registering; (ii) maintain and promptly update your account information as necessary; (iii) keep your login credentials confidential and not share them with any other person; and (iv) notify us immediately at info@nomadsauna.com if you suspect unauthorized access to or use of your account.

You are solely responsible for all activity that occurs under your account, whether or not you authorized it. Nomad Sauna is not liable for any loss or damage resulting from your failure to maintain the security of your account credentials.

B. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may close your account at any time by contacting us at info@nomadsauna.com. Upon account closure, your account data will be handled in accordance with our Privacy Policy.

C. One Account Per User

You may not create more than one account, create accounts on behalf of others without their authorization, or use another person's account without permission.

4. Booking Sauna Seats and Private Rentals

A. Booking Process

You may book individual sauna seats or private rental sessions through our Website. All bookings are subject to availability. Submission of a booking request and payment does not guarantee availability until you receive a confirmation from us.

B. Payment

All seat and rental bookings require payment at the time of booking. Payment is processed through our designated third-party payment processor. By providing payment information, you authorize the payment processor to charge your selected payment method for the amount due. We do not store your credit card or financial account information on our servers.

C. Cancellations and Refunds

Cancellation and refund terms for seat and rental bookings will be presented to you at the time of booking and will govern your specific reservation. Refund eligibility depends on the timing of cancellation relative to your scheduled session. We reserve the right to cancel or reschedule sessions and will provide reasonable notice and a full refund in the event we are unable to fulfill a confirmed booking.

D. Custom Sauna Purchases

All custom sauna purchase transactions are governed exclusively by a separate signed Sauna Purchase Agreement between Nomad Enterprises LLC and the buyer. No terms on this Website create any obligation on our part to sell, deliver, or manufacture a custom sauna. If you have questions about purchasing a custom sauna, please contact info@nomadsauna.com.

5. Acceptable Use

You agree to use our Website only for lawful purposes and in accordance with these Terms. You agree not to:

• Use our Website in any way that violates applicable federal, state, or local law or regulation
• Use our Website to transmit or post any content that is defamatory, obscene, fraudulent, threatening, harassing, or otherwise objectionable
• Attempt to gain unauthorized access to any part of our Website, our servers, or any systems or networks connected to our Website

Our total cumulative liability to you for any and all claims arising out of or relating to these Terms or your use of our Website shall not exceed the greater of (a) five hundred dollars ($500.00) or (b) the total amount you actually paid to Nomad Sauna through our Website in connection with the specific transaction or booking from which the claim arose.

The foregoing limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability will be limited to the fullest extent permitted by applicable law.

Any claim by you arising out of or related to these Terms or your use of our Website must be commenced within one (1) year after the cause of action accrues, or it will be permanently barred.

The limitation of liability set forth in this Section applies to Website use and online booking transactions only. Claims arising from a custom sauna purchase are governed exclusively by the applicable Sauna Purchase Agreement.

10. Assumption of Risk

There are certain risks associated with using our products and services, including exposure to hot temperatures and hot equipment.

By booking a seat or private rental, you acknowledge that you are aware of and accept these risks. Your use of our sauna facilities is entirely voluntary. Nomad Sauna is not responsible for any accident or injury resulting from your use of our sauna facilities. You assume all risk and responsibility for accident, injury, death, and damage to personal property while using our sauna facilities.

11. Force Majeure

Nomad Sauna shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, storm, earthquake, epidemic or pandemic, governmental action or restriction, labor disputes, supply chain disruptions, power failures, or failures of third-party service providers. In such circumstances, we will make reasonable efforts to resume performance as soon as practicable.

No statement, depiction, or other communication made by Nomad Sauna or its representatives shall be construed as a representation or warranty that any sauna product meets any accessibility standard.

Buyers intending to use any sauna product in connection with a place of public accommodation or any other setting where accessibility requirements may apply assume sole and exclusive responsibility for determining all applicable requirements and ensuring compliance. 13. Pricing and Payment

Seat and private rental prices displayed on our Website are subject to change at any time without notice. We endeavor to ensure that all prices displayed are accurate and current. In the event of a pricing error, we reserve the right to correct the error and, if applicable, cancel the affected booking with a full refund.

All payments are processed by our designated third-party payment processor. You agree that you are responsible for all charges and applicable taxes associated with your booking. We are not responsible for errors by our payment processor.

17. Governing Law, Dispute Resolution, and Venue

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws provisions, regardless of where you are located.

If any dispute, controversy, or claim arises between you and Nomad Sauna relating to these Terms or your use of our Website, the parties will first attempt to resolve the matter informally by contacting us at info@nomadsauna.com. If the dispute is not resolved informally within thirty (30) days, the parties agree to submit the matter to mediation before a mutually agreed mediator in St. Croix County, Wisconsin, prior to commencing any litigation.

If mediation does not resolve the dispute, the sole and exclusive venue for any litigation shall be the courts serving St. Croix County, Wisconsin. You hereby consent to the personal jurisdiction of the courts of St. Croix County, Wisconsin for this purpose.

Notwithstanding the foregoing, nothing in this Section limits our right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable, in a manner that most closely reflects the parties' original intent.

19. Waiver

Our failure to enforce any provision of these Terms at any time shall not be construed as a waiver of that provision or of our right to enforce it in the future. No waiver of any provision shall be effective unless in writing and signed by an authorized representative of Nomad Sauna.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nomad Sauna with respect to your use of our Website and the services described herein, and supersede all prior or contemporaneous understandings and agreements. These Terms do not govern custom sauna purchase transactions, which are governed exclusively by a signed Sauna Purchase Agreement.
